Terms of Service
The terms that govern your use of the Ledgera platform. Please read them carefully.
These Terms of Service ("Terms") govern your access to and use of the Ledgera platform, including the application at app.ledgera.africa and the website at ledgera.africa (collectively, "the Service").
By creating an account or using Ledgera in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Ledgera is a group financial management platform designed for chamas, savings groups, and investment groups. It allows group administrators to record contributions, manage loans, generate reports, and give members access to their own financial records within the group.
Ledgera is a record-keeping tool. It does not hold, transfer, or manage actual money on behalf of any group or member. All financial transactions (such as M-Pesa payments) occur outside the platform. Ledgera records what you tell it.
2. Account registration
To use Ledgera, you must register for an account. You agree to:
- Provide accurate and complete information during registration
- Keep your password confidential and not share it with others
- Notify us immediately if you suspect unauthorised access to your account
- Be responsible for all activity that occurs under your account
You must be at least 18 years old to create an account.
3. Acceptable use
You agree to use Ledgera only for lawful purposes. You must not:
- Enter false, misleading, or fraudulent financial records
- Use the platform in a way that harms or deceives other group members
- Attempt to access another user's account without authorisation
- Reverse engineer, copy, or reproduce any part of the platform
- Use Ledgera to facilitate money laundering, fraud, or any illegal activity
- Introduce malware or attempt to disrupt the Service
4. Administrator responsibilities
Group administrators are responsible for:
- The accuracy of financial records entered into the platform
- Managing member access and roles appropriately
- Complying with their group's own constitution or agreed rules
- Ensuring that records entered reflect actual transactions that occurred
Ledgera is a tool that reflects the information you enter. We are not responsible for disputes arising from inaccurate data entered by administrators.
5. Data and privacy
Your use of Ledgera is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of data as described in the Privacy Policy.
Financial records entered into Ledgera are the property of the group. If a group administrator closes the account, members should ensure they have downloaded any statements they need before account closure.
6. Service availability
We aim to make Ledgera available at all times, but we cannot guarantee uninterrupted access. We may suspend or modify the Service for maintenance, security, or other reasons. We will provide advance notice of planned downtime where possible.
7. Limitation of liability
To the maximum extent permitted by Kenyan law, Ledgera shall not be liable for:
- Financial losses arising from inaccurate data entered by administrators or members
- Disputes between group members regarding contributions, loans, or decisions
- Loss of data caused by circumstances outside our reasonable control
- Indirect, incidental, or consequential damages
Our liability to you for any direct loss arising from use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
8. Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law.
On termination, you lose access to the platform. We recommend downloading all records and statements before closing your account.
9. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "last updated" date above and notify you via email or a notice on the platform. Continued use of Ledgera after changes constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of Kenya.
